• Le 30 mai 2005, une réponse a été reçue du Gouvernement sud-africain. Dans son courrier, ce dernier indique qu'il approuve en grande partie la formulation de la nouvelle définition tout en proposant de modifier comme suit la deuxième phrase du paragraphe 1 b) de l'article premier (version anglaise) : « However, an exception is made where a national of a country affected by the crime is hired to commit the crime in his country of nationality and uses his status as national to conceal the fact that he is being used as a mercenary by the State or organization that hires him ».
